Separations are formal agreements between spouses. They provide for support and financial conditions until the divorce is final. It is important to to get this in the form of a court order. In the case where both spouses can agree on the terms they probably won't have to appear in court, as their attorney will take the signed agreement to the judge who will sign it thereby making it a court order. Your separation agreement is something you and your spouse should negotiate.

There are a number of reasons to use separations. The first one is to keep a dependent spouse on the other's employer-provided medical benefits for as long as possible, since many health plans allow coverage to be maintained for a legally separated non-employee spouse, but will not continue coverage once divorced. Separation agreements are also chosen because they do not seem as "final," and are believed to be easier should there be a reconciliation between the parties.
